TiVo, AT&T patent settlement will send at least $215 million TiVo's way through 2018

After leveraging its DVR patent portfolio into a $500 million settlement with Dish Network and Echostar TiVo has made it rain again, cutting a mutual patent licensing deal with AT&T that settles their litigation and will result in at least $215 million heading its way through 2018. Additional license fees are possible based on AT&T's U-verse DVR subscriber base, so besides the $51 million up front and recurring payments after that, there could be even more money at stake. Despite intervention on its behalf by Microsoft, AT&T apparently decided caving was the best option. Next we'll see what happens next in a similar battle with Verizon and whether TiVo decides to continue developing its products or just sit back and let the licensing money roll in. CEO Tom Rogers said in a statement (included after the break) that it provides TiVo rights to "innovate TiVo products and services under license from AT&T", although if it were us we'd make the call after taking a Scrooge McDuck-style dive into a pool filled with Dish and AT&T's money.

Saints stomp Panthers

Drew Brees, Jason Shirley

By BRETT MARTEL

updated 6:43 p.m. ET Jan. 1, 2012

NEW ORLEANS - Drew Brees set a merciless tone with relentless, aggressive, pinpoint passing and the New Orleans Saints shrugged off injury risks, barreling into the postseason with an all-out effort.

"Every facet of our offense is clicking right now, but yet you're constantly finding ways to advance it," Brees said. "We've raised the bar for ourselves. We have a high level of expectations, and we're just trying to meet that level."

Brees passed for 389 yards and five touchdowns, and the Saints set a slew of NFL and club records in a 45-17 blowout of the Carolina Panthers on Sunday.

The NFL single-season records set by the Saints (13-3), who head into the playoffs on an eight-game winning streak, included offensive yards with 7,474, team yards passing with 5,347 and first downs with 416.

Brees, who was 28 of 35, finished with a record 468 completions this season, breaking Peyton Manning's 2010 mark of 450. He finished the season completing 71.6 percent of his passes, breaking his own 2009 NFL record 70.6 completion percentage.

In terms of playoff seeding, New Orleans gained nothing with the victory, finishing with the third seed because San Francisco (13-3), which had a better conference record, held onto the second seed by winning at St. Louis.

Yet New Orleans hadn't forgotten the bitterness of limping into the playoffs with a loss in their last regular-season game a season ago before being bounced by underdog Seattle in the first round.

"You obviously saw the result last year, and we didn't feel like we came out and played well or carried momentum into the playoffs," Brees said. "I feel like we're playing our best football right now. This is where we wanted to be."

Jimmy Graham had 97 yards receiving to finish with 1,310, exceeding Kellen Winslow's 1980 record of 1,290 for a tight end. But New England's Rob Gronkowski finished with 1,327 yards, establishing a new mark.

Darren Sproles had 40 yards rushing, 29 yards receiving and 99 yards on kickoff and punt returns to finish with season with an NFL record 2,969 combined yards, easily breaking the previous mark of 2,690, set by Derrick Mason with Tennessee in 2000.

Carolina (6-10), which had won four of five, kept up for much of the first half but wilted over the final two quarters while the Saints set a franchise single-game record with 617 yards of total offense.

"We caught a football team that is on a roll right now," Panthers coach Ron Rivera said. "That's a playoff-caliber football team that did that to us."

Marques Colston caught Brees' first two scoring passes, making a spectacular, spinning catch with arms outstretched on the first one from 15 yards out.

Colston's second touchdown went for 42 yards, and he finished with seven catches for 145 yards.

Afterward, Colston, who studied psychology at Hofstra, declared: "Mentally and emotionally, we're as prepared as a team can be."

Brees also connected with Graham on a 19-yard scoring strike, and added TD passes of 9 yards to Sproles and 1 yard to fullback Jed Collins.

Graham's TD catch was his 11th, matching a club record also reached by Joe Horn in 2004 and Colston in 2007.

Brees surpassed 300 yards passing for the seventh straight game and 13th time this season, both NFL records he already held and simply extended.

The records come one week after Brees passed Dan Marino's 27-yard-old single-season record of 5,084 yards passing.

Brees finished the season with 5,476 yards to go with 46 touchdown passes, fourth most in NFL history. First is New England's Tom Brady with 50 in 2007.

Remarkably, Brees didn't even play most of the fourth quarter for the second time in three games. As was the case in a 42-20 win at Minnesota two weeks earlier, Brees was relieved by Chase Daniel after the Saints had built a commanding lead.

With six touchdowns against Carolina, the Saints finished with 66 this season breaking the 2009 record of 64. New Orleans' 547 points smashed the 2009 club record of 510 and was the third highest total in NFL history behind the 2007 Patriots (589) and the 1998 Minnesota Vikings (556).

Still, Brees balked at the opportunity to engage in much self-congratulating for the history he and head coach Sean Payton's offense have made this season.

"All this stuff along the way is awesome and special and we can reflect on that for years and years, but you play this game for championships, for rings, because that links you together forever," Brees said. "Here we are having accomplished so much, and yet the ultimate prize is still out there."

Cam Newton closed out an otherwise spectacular rookie season 15 of 25 for 158 yards, one touchdown and one interception.

"It was embarrassing how we ended that game," Newton said. "Offense, defense, special teams, the whole 9 yards, it was real tough."

The Saints had 360 yards of total offense in the first half, when they easily blew past the Rams' 2000 yardage record of 7,075.

Brees passed for 249 yards in the half, when he hit Colston for the Saints' first two passing touchdowns.

Both defenses struggled for much of the half, and each team might have scored more if not for Patrick Robinson's interception of Newton in the Saints' end zone and R.J. Stanford's interception of Brees deep in Panthers territory.

Chris Ivory gave the Saints a 7-0 lead on the opening series of the game with his 35-yard touchdown run.

The Panthers hit right back with Newton's 12-yard timing pass to Steve Smith to tie it. Later, Jonathan Stewart's 29-yard scoring run pulled the Panthers into a tie at 17 with 1:18 to go in the second quarter.

That was too much time for Brees who connected on his long TD pass to Colston with 7 seconds on the clock to make it 24-17 at halftime.

NOTES: Colston set a club record with his fifth 1,000-yard season with the Saints, moving ahead of Joe Horn, who had four. ... Saints P Thomas Morstead set a record for punting average in a season at 47.9 yards. ... The Saints went 8-0 at home for the first time in franchise history. ... Carolina officials said after the game that CB Darius Butler had a broken arm, but they did not specify which one, while TE Greg Olsen had a concussion. ... Newton was sacked twice, bruising his non-throwing left elbow on one sack by rookie Saints linebacker Martez Wilson. ... Payton said WR Robert Meachem was taken out of the game as a precaution with knee pain in the third quarter.

This undated photo obtained from a facebook page shows missing toddler Alya Reynolds. Police in Maine are appealing to the public for help in locating the 20-month-old girl who was last seen Friday night. Waterville Police Chief Joseph Massey held a news conference this afternoon to ask anyone with information about Ayla Reynolds to call police. Ayla's father called police yesterday morning to report that his daughter was not in her bed and couldn't be found. She was last seen sleeping at about 10 p.m. Friday by a family member. (AP Photo/obtained from Facebook)

PORTLAND, Maine (AP) ? Police investigating the disappearance of a toddler from her father's central Maine home two weeks ago said Friday they believe foul play was involved, but investigators tried to remain optimistic even as the job of law enforcement officials becomes more difficult with each passing day.

Waterville police Chief Joseph Massey announced Friday night that the case "has evolved from the search for a missing child to a criminal investigation."

In a statement, the chief said the conclusion about the disappearance of 20-month-old Ayla Reynolds was based on evidence that has been gathered over the past two weeks, but he didn't elaborate. He said state police would take the lead on the investigation.

On Friday, a team of evidence technicians from Massachusetts joined Maine State Police at the Waterville home where Ayla was last seen and was reported missing by her father.

"All of our efforts continue to locate Ayla. Although this is beginning the third week, we remain hopeful," Maine Department of Public Safety spokesman Stephen McCausland said. He declined to say what the technicians were looking for.

Ayla's father, Justin DiPietro, told police he last saw her when he put her to bed the night of Dec. 16. He reported her missing when she was nowhere to be found the following morning.

Before she vanished, Ayla was wearing green polka dot pajamas with the words "Daddy's Princess" on them and had a soft cast on her broken left arm. Extensive searches of woods, waterways, fields and private properties around Waterville, a city of 16,000 residents 20 miles north of the state capital, Augusta, have failed to turn up anything.

The day after Christmas, investigators announced a $30,000 reward, the largest ever for a missing person case in Maine, for information leading to Ayla's whereabouts.

McCausland on Friday declined to discuss whether any of the 300-plus leads had borne fruit for investigators. He also declined to talk about suspects or evidence that has been gathered. He said DiPietro and Ayla's mother, Trista Reynolds, of Portland, were cooperating with investigators.

There were news reports Friday that two cars seized from the Waterville home were returned to DiPietro and an unidentified woman. McCausland declined to confirm those reports.

Investigators put up crime scene tape at the father's home last week. Outside the home, about 75 miles from Portland, a pile of teddy bears and stuffed animals were piled at a makeshift shrine.

Ayla was placed in her father's care while her mother was in a substance abuse rehabilitation program, which she completed.

Trista Reynolds, making an appeal on national television on Thursday, said that she had questions for DiPietro but that he had not returned her calls since their daughter went missing. She previously raised concerns about Ayla's treatment while in her father's care after the girl broke her arm, which police said happened in an accidental fall. She had no further comment Friday night, her sister said.

DiPietro couldn't be reached for comment Friday night. The Associated Press has been unable to find a telephone listing for him, and he has not been at his home, which is empty.

A few days before Christmas, DiPietro, addressing the public for the first time, said in a statement he had "no idea what happened to Ayla or who is responsible." He said his family and friends would do "everything we can to assist in this investigation and get Ayla back home."

"I would never do anything to hurt my child," he said Wednesday in another statement.

Former FBI profiler Clint Van Zandt said Friday that the odds of finding a child lessen if he or she isn't found within the first day or two of disappearing. But he said there's always reason for optimism, noting that there are even rare cases of missing children who turn up years later in someone's care.

"If you don't get this child back real quickly, you know that it gets harder and harder," he said. "But you can't give up hope."

Scott Bernstein, founder of Child Recovery International, a New York City-based organization that helps find missing children, agreed the first hours of an investigation are key in tracking down missing children as young as Ayla. Although the situation looks bleak, there's still room for hope, he said.

"One percent hope ? but I'll go for that 1 percent hope," he said.

After Ayla went missing, law enforcement officials likely divided their investigation into two parts, one team looking at people with access to her, such as relatives and family friends, and another group looking at the potential for an abduction by an outsider or stranger, Van Zandt said. Under both scenarios, he said, the odds are that the person who took Ayla knew something about her or her family.

Strangers' abductions of children do occur, but they're rare, accounting for only 105 to 115 children out of 750,000 to 900,000 missing-persons cases each year in the United States, Van Zandt said.

Van Zandt, who has worked similar cases, said Ayla's disappearance, which once had more than 80 searchers and law enforcement officers involved, has been difficult for law enforcers as well as for distraught family members.

"As an FBI agent working these cases, you never turn off the emotional porch light," he said. "You always leave on the light with the hope that the child will come home again."

SC tornado victims face rebuilding new year

--?

Mud, Jabo Ferrell explains, is "where the kitchen was."

"There's no kitchen any more," said Ferrell. "No living room either. Or den. Or porch. Or anything else."

Albert "Jabo" Ferrell, a builder all his life, whose hands are so hard they may as well be made of steel like the hammer he carries, stood in the dirt on the exact spot where he and his wife, Judy, were when the Nov. 16 tornado hit.

They were on the couch, watching television.

"We heard it and I started to get the couch to put over her, keep the roof from falling on her, and I looked up and there wasn't any roof," Jabo Ferrell recalled. "There was debris all over us. The place was gone all around. And all that happened was I got a little cut on my head. Can't tell me God wasn't watching over us that day. No one can tell me God doesn't have a plan for me."

Somehow, the old farmhouse destroyed around them, the Ferrells survived. A pecan grove as old as the house was destroyed. Other hundred-plus year old oak and pine trees were gone.

The house, and almost everything in it, was blown away or destroyed.

All that remained was the carport, an oil tank, a chicken house, and a pump house.

"I never wavered in that God had a plan for me, and that in doing good the best I could all my life, I was being rewarded," Ferrell said. "So I could do more."

The toll from the Nov. 16 tornado that hit a two-mile stretch about 200 yards wide south of Rock Hill was breathtaking and brutal.

Three people were killed. Oran Steve Courtney of Williamson Road died when his chimney fell on him. Barbara and Charles Kenneth Hafner of S.C. 324 - who lived across the street from Jabo Ferrell's house - died when the storm ripped their mobile home from its foundation.

A dozen people were injured, eight homes were destroyed, and more than 20 other buildings damaged.

Nathan Courtney, who lost his father, Steve, in the storm said the family is still dealing with the devastation.

"One day at a time," Nathan Courtney said. "It has been very difficult. Nobody really felt like celebrating at Christmas."

Steve Courtney saved his daughter and granddaughter before he died.

The family has not decided about rebuilding the home. Because the economy is so rough the family's electric business has not re-opened. The outpouring of support from the Courtney's home church, Northside Baptist, and from others at Oakdale Baptist Church and many more in the community, has been a blessing, Nathan Courtney said.

"We are looking at the new year and hoping it will be better," he said. "It couldn't get any worse."

For Patricia Cox, whose mother and stepfather, Barbara and Charles Hafner, died in the storm the hope for the new year is that the family can recover from such a loss.

At Christmas she bought her 4-year-old son Ethan a "Cars 2" DVD because her mother had already bought one for him. Like so much of what the Hafners owned, the Christmas gift was destroyed in the storm.

"I put on there that it was from them, for Christmas, because it really was," Cox said. "This was a hard holiday season."

The tornado was the worst York County disaster of 2011 because of the loss of lives, said Cotton Howell, York County's longtime emergency management director. In terms of dollar damage and property damage, the spring storms caused more destruction. From Clover to Sharon, Hickory Grove to Rock Hill, hundreds of houses were damaged in the spring.

Yet in those storms that uprooted trees, clogged roads, knocked out power, damaged buildings, people survived.

"Roofs can be replaced," Howell said. "Lives can't. York County lost three people in the tornado. No one will ever forget them."

The dollar estimate for damage from the tornado has not been finalized because all property owners have not yet reported what they lost, Howell said.

Some residents were upset after the storm that York County did not use government heavy equipment and workers for jobs other than clearing roads and police protection, leaving private contractors to volunteer their heavy equipment to remove debris.
