Maximum PC | Gaming Companies Quietly End Official Support for ...

capitolWith each revision, the list of SOPA supporters seems to be shrinking. In the most recent silent update, gaming companies seem to be the ones pulling back. Sony, EA, and Nintendo are no longer listed as supporters of the bill, but were on the list in November. None of the companies has acknowledged the change in position.?

SOPA and its companion Senate bill Protect IP, would place much more power in the hands of copyright holders. The broad wording of the bill could label many sites with user-generated content as ?rogue sites,? and expose them to domain blocking by US ISPs. Experts on internet infrastructure are concerned that modifying the DNS system in this way could damage internet reliability and security.

All three gaming companies have an interest in limiting piracy of their games, but with SOPA becoming toxic withing their target demographic, it?s no surprise we are seeing pull-back. Sony, EA, and Nintendo have joined GoDaddy in no-longer supporting SOPA, but we should note that none of these companies have actually come out against the bill.?

George Weah, Nwankwo Kanu & the 10 stars who never won the Africa Cup of Nations

Africa has produced some exceptionally gifted players who have never tasted glory in the continent?s most prestigious competition, the Africa Cup of Nations. Some of these are men who have won the biggest individual awards in various leagues worldwide. And, football being a team sport, some have been cursed with underachieving national teams. This has ensured that they finished their careers without ever lifting the Afcon trophy.

Some, like George Weah, Kalusha Bwalya, Mustapha Hadji and Anthony Yeboah, have retired from the game. Others, like Nwankwo Kanu, Frederic Kanoute and El Hadji Diouf, have called time on their international careers, while Didier Drogba and Michael Essien are in the twilight of their journeys with their national sides.

Goal.com looks at these important players and how close they came to winning the coveted trophy over the course of their careers.

Zambian great Kalusha Bwalya was a nearly-man at the Afcon in 1994 when the Chipolopolo made a memorable push for the title a few months after losing most of their first team in a plane crash. Bwalya led the Zambians to the final of Tunisia 94, where they narrowly lost 2-1 to Nigeria.

Two years later, he led the Zambians to a third-place finish in South Africa, where he won the Golden Boot. The former winger, who was named African Player of the Year in 1988, played in five Afcon tournaments and was coach in 2006.?


Two-time African Player of the Year El Hadji Diouf ended his career without an Afcon title. The 'Serial Killer' played at four tournaments and came closest in 2002, when the Teranga Lions finished second to Cameroon in a penalty shootout.

Diouf?s career has been overshadowed by on- and off-field controversies as his best football years ebbed away, but an Afcon title would certainly have been the highlight of his international career.


DIDIER DROGBA (IVORY COAST)

Another twice named African Footballer of the Year, Drogba has not won the title in three appearances at the tournament. He came closest to winning in 2006 when his Ivory Coast side reached the finals but lost to hosts Egypt in a shootout, after regulation time ended goalless.

The Chelsea striker still has one more opportunity to win the competition, as he will lead his golden generation of Ivorian stars to the tournament in Gabon and Equatorial Guinea in January 2012.


Chelsea midfield strongman Michael Essien has been out injured for the better part of two years and has seen his place in the Black Stars filled by much younger players. However, during the height of his prowess, the 'Bison' failed to win the Afcon title, coming closest in 2010 as the Ghanaians took silver, losing to Egypt.

If his injuries continue, Essien could end his international career without a continental title. He has played in three Afcon tournaments.


Mustapha Hadji?s most memorable moment at the Afcon was his overhead kick to score against Egypt in their 1998 group-stage win. Hadji won that year?s African Player of the Year award on the back of his performance at the World Cup.

Two years later, Morocco crashed out of the tournament in the group stages and any dream Hadji had had of winning the coveted trophy went up in smoke, as the north African star could not cap his career off with an Afcon title.


The 2007 African Player of the Year came closest to winning the Afcon title in 2004 when Tunisia hosted the tournament. The Malians showed inspired form to reach the semi-finals, powered by four goals from Kanoute.

However, they were undone by Morocco in a 4-0 defeat, with Kanoute finishing as joint-top scorer. In 2008 and 2010, the Eagles failed to make it past the group phase, and so Kanoute retired from international football without an Afcon title.


The forward, twice African Player of the Year, participated in six tournaments and came closest to winning in 2000, when Nigeria finished second. He lost the final in a penalty shootout against Cameroon and soon after the Super Eagles became perennial bronze-medal winners.

His Afcon record is one silver and four bronze medals, but perhaps even more surprising is that lanky Kanu never scored a goal from open play in the competition.


Zimbabwean great Peter Ndlovu played at two Afcon tournaments but never went further than the group stages. He scored three goals for the Warriors at their maiden tournament in 2004.

He was also a part of the Zimbabwe side that stunned World Cup-bound Ghana 2-1 in their 2006 group. The former Coventry and Birmingham City striker is one of the biggest names from the southern part of Africa to have never won the competition.


The 1995 Fifa World Player of the Year, George Weah played at two Afcon tournaments with the Lone Stars in 1996 and 2002, but crashed out in the first round on both occasions. Weah scored a goal in the 2002 tournament during an opening 1-1 draw with hosts Mali.

Considering his individual brilliance and the awards he won during his career, Weah is one of the biggest African names to not have tasted victory in the competition.


The Ghanaian great, Anthony Yeboah missed out on the Afcon title in 1992 when the Black Stars lost the final in a drawn-out penalty shootout against the Elephants of the Ivory Coast.

The Eintracht Frankfurt and Leeds United legend played two more tournaments in an effort to be crowned an African champion, but the Black Stars could not reach the heights that they achieved in 1992 with the team that included Abedi Pele, Nii Odartey Lamptey and Anthony Baffoe.

    Matthew McConaughey engaged to longtime girlfriend (AP)

    LOS ANGELES ? Matthew McConaughey is engaged to marry his longtime girlfriend, Camila Alves.

    The 42-year-old actor proposed to the Brazilian model on Christmas Day. He announced the move in a tweet that included a photo of the couple kissing and read, "just asked camila to marry me, merry Christmas."

    McConaughey's publicist confirmed the engagement Tuesday.

    McConaughey and Alves have two children together, son Levi and daughter Vida.

    His film credits include "We Are Marshall," "Tropic Thunder" and "The Lincoln Lawyer."

    O'Reilly Automotive

    O'Reilly Automotive (ORLY) continues to rise despite lofty valuation, the stock remains a Zacks #1 Rank (Strong Buy).

    Company Description

    O'Reilly Automotive is a specialty retailer of automotive aftermarket parts, tools, supplies, equipment and accessories.

    Good Earnings

    We have to go back to Oct 26 for the last quarterly report, but it was a good one. Net income increased 27% or $32 million ahead of the year ago level of $117 million. Revenue for the period was up 8% to $1.54 billion.

    Earnings per share came in at $1.10, 10% ahead of what analysts polled by Zacks were expecting. After meeting earnings expectations in the June quarter of 2011, ORLY has returned to posting an earnings surprise.

    More Shares to be Repurchased

    On November 16, the company announced its intention to increase a share repurchase program. Adding $500 million to the existing program brings the total to $1.5 billion. Prior to the increase, the company had repurchased 14.4 million shares for $859 million for an average price of $59.81, well below current levels.

    Valuations

    Shares of ORLY are not cheap by most metrics, but underlying metrics such as sales per store and sales per square foot increased in the most recent quarter.

    The stock is trading at a premium to its direct competitors with a 21.4x forward PE. By comparison, Autozone (AZO), a Zacks #2 Rank (Buy) stock trades at 14x forward earnings estimates.

    Burlington Church Too Loud, Neighbors Say

    BURLINGTON, N.C. (WGHP)?

    While some neighbors say a Burlington church makes too much noise, police say it isn't breaking the city's noise ordinance.

    Lori Darnell said she and others have called police multiple times about Faith Builders International Church on May Drive. Her backyard is next to the church, which moved in this past fall.

    "I hear the bass thumping in my house--just a constant 'thump, thump, thump' for hours. I can't live with it. It's that bothersome," Darnell said.

    Darnell said she heard loud noises from the church Wednesday through Sunday one week, and from Saturday to Wednesday another week.

    "There was one weekend it was five hours on Saturday and on-and-off on Sunday until like 9 p.m.," Darnell said.

    "Inside that room (in my house) I could still hear them yelling, and it was not 'Hallelujah,'" said another neighbor. "I originally thought it was Williams High School band practice, but I couldn't figure out why it was going on every night."

    Captain Eric Kerns with Burlington Police said officers have been to the church more than 20 times, but they haven't heard what neighbors are complaining about.

    "No one has reported yet of hearing, upon our arrival, obnoxious or unreasonable noise that they could hear in the residence," Kerns said.

    Kerns said the church is not in violation of the city's noise ordinance, saying the noise is "part of their business operations."

    Burlington Police told residents they can go before city council during a public comment session if they want to make an amendment to the noise ordinance.

    Meanwhile, Darnell said she can't believe the reason she is considering a move is a church.

    "A church is supposed to come into a community and bring goodwill and all that, right?" Darnell said.

    Church officials could not be reached for comment Wednesday.

    Netflix, Gap lag in customer satisfaction online (Reuters)

    (Reuters) ? Netflix Inc and Gap Inc were among the worst performers in customer satisfaction among the largest online retailers this holiday season, according to a survey released on Wednesday.

    Overstock.com Inc came last out of the 40 largest online retailers, with a rating of 72 out of 100, down 4 points from last year, the survey by ForSee found.

    Gap.com, Gap's main website, was second last with 73 points, down 5 from a year ago. Other laggards included buy.com and websites run by Sony and Toys R Us, ForSee said.

    Customer satisfaction is important for retailers because it can lead to higher sales, more loyalty and increased word-of-mouth recommendations, ForSee said.

    Netflix saw the biggest decline in customer satisfaction in ForSee's most-recent survey after the company tried to raise prices and split its DVD and video-streaming services. The plan was scrapped after customers defected.

    "Netflix totally misread its customer base and is paying the price, damaging its brand among both consumers and investors," said Larry Freed, chief executive officer of ForSee.

    Netflix shares lost more than half their value this year, with most of the damage coming after the company unveiled its intention to split its services.

    Netflix had come close to customer-satisfaction leader Amazon.com in previous ForSee surveys. But in the latest poll, Netflix dropped 7 points to 79, the largest decline of any retailer in the survey.

    Amazon climbed 2 points to 88 to lead ForSee's survey for the 14th consecutive time. ForSee runs the poll about every six months.

    The biggest gainer was TigerDirect.com, a tech gadget and parts website owned by Systemax Inc, which climbed 6 points to 79.

    Another big gainer was JCP.com, J.C. Penney's website, which rose 5 points to 83. That put the retailer in a tie for third place with QVC.com, Apple's online store and VistaPrint.com. (Reporting by Alistair Barr; Editing by Tim Dobbyn)

    NY sheriff hawks naming rights for helicopter (AP)

    SYRACUSE, N.Y. ? A high-tech helicopter has helped Sheriff Kevin Walsh chase down fugitives, airlift accident victims and spearhead search-and-rescue missions in the Syracuse region of central New York since 1999. In 2012, Air-1 could be grounded by budget cuts.

    Walsh's proposed solution? Slap a corporate logo on the Bell 407 chopper to raise ad revenue and keep her flying.

    "We (police) have put up with donut jokes for our entire existence. I think we can tolerate jokes about the Price Chopper chopper or the Wegmans whirlybird showing up," Walsh said, referring to two supermarket chains. "I don't like the idea of our having to fund public services with private donations, but the option is not to have that public service."

    While hawking naming rights for municipal stadiums, parks, mass-transit stations and other public entities is nothing new for the nation's cash-strapped cities, sponsorship deals with police agencies are much less common, and typically less lucrative.

    On top of that, watchdog groups ? and many in uniform ? are wary about potential conflicts when law enforcement cozies up with advertisers, such as officers possibly looking the other way on matters involving corporate sponsors.

    "I feel very confident my officers wouldn't be compromised," said John Kelly, police chief of Littleton, Mass. A town-approved $12,000-a-year contract with a grocery chain pays for one of Kelly's five patrol cars. In return, the cruiser has been adorned for nine years with a modest Donelan's Supermarkets bumper sticker.

    Kelly said he's endured plenty of flack, but "my position is I have to give my officers tools to provide the necessary services our citizens paid for. At 2:30 in the morning, someone laying out on a local highway because of an accident really doesn't care who's paying for the cruiser or what it says on its side."

    In 2002, dozens of cities jumped at an offer by a Charlotte, N.C., company to provide new police cars for $1 each in exchange for festooning them with race car-style logos. The venture fizzled, in part because the line between tactful and tacky advertising can be a narrow one, and the company has gone out of business.

    "We can't let cutesy things" subtract from "making us look serious," said police Chief Philip Thorne in Springfield, Fla., which turned down a chance to save $500,000 over three years.

    "It sounded like a good idea," recalled Bruce Owens, police chief in Summerville, S.C. "But the main concern is the potential ethical issues you might encounter, because no one gives something for nothing."

    Russ Haven of the New York Public Interest Research Group fears the drive to find sponsorship arrangements in budget-strapped times "may in some instances seem unseemly or feel like it's going too far.

    "When it comes to law enforcement, you have this additional layer of concerns," Haven said. "If the sponsor becomes a target of an investigation, does the public have confidence they'll be treated equally under the law?"

    In addition, "what's the appropriate valuation for naming rights?" Haven said. "Does it put government in the position of deciding what is an inappropriate sponsor, which could raise First Amendment issues?"

    In Syracuse, the sheriff's budget woes in recent years deepened this fall when the county Legislature eliminated $591,000 in taxpayer aid in 2012 for the helicopter known by its radio call sign. Bought for $2.3 million, Air-1 costs around $500,000 on average to operate and maintain each year.

    Walsh has appealed for private donations and hopes to secure federal grants to help pay for Air-1's four-pilot roster. Getting a commercial operator's license from the Federal Aviation Administration to allow him to charge fees for medical flights might come through soon, potentially raising $125,000 to $200,000 a year.

    Selling naming rights could prove vital in filling the gap. Talks are under way with two potential sponsors who remain unidentified, and Walsh's administrative chief, John Balloni, hopes to add at least $100,000 a year in advertising revenue.

    While conceding that Air-1 might have to stop operations in 2012, Balloni said: "There will be some revenue streams coming in and we have full expectation we'll keep it in the air. The extent of our success in 2012 will determine how much we fly in 2013."

    Landing private funding wouldn't be a first for a police airborne unit. In Missouri, St. Louis County police got cash donations and electronic equipment worth upward of $200,000 from three helicopter manufacturers in 2004 in exchange for putting the companies' decals on three of its six choppers, said Capt. Kurt Frisz, a pilot.

    "It kept us flying at a critical time and got us equipment we wouldn't have been able to afford otherwise," said Frisz, who says the decals are hardly visible from the ground. "The value for the vendor is if a picture of our helicopter shows up in a law enforcement trade magazine such as Air Beat."

    Onondaga County sheriffs have deployed helicopters of their own since snapping up a Korean War-era bubble model in 1975.

    Supporters praise the new chopper's versatility and credit it as a vital public safety tool not only in the county but in emergencies across a five-county metro area of 640,000 people along Lake Ontario's southeast corner.

    Air-1 and its crew logged hundreds of hours of missions in 2011. It airlifted a badly injured toddler who was run over by a lawnmower, alerted sheriff's deputies to a rifle-toting fugitive hiding up a tree and rescued a man whose snowmobile plunged through the ice on a lake.

    Opponents view it as a financial burden that duplicates services already provided at no cost to taxpayers by private medevac helicopters and a state police chopper stationed in Syracuse that runs missions farther afield in upstate New York.

    A county Legislature resolution to auction off Air-1 was voted down 18-1 on Dec. 6. Walsh will likely renew his funding request when the Legislature returns Jan. 1 with seven new members.

    "Short of robbing banks," said Balloni, his deputy, "any way we can keep this ship flying is the way we're going to do it. I took an oath to protect and serve and, to me, the lives it saves are what's sacred."

    Toledo man arraigned for soliciting underage girls on Facebook

    PERRYSBURG, OH (WTOL) ? A Toledo man faced a judge Friday and is now behind bars after being accused of trying to lure young girls to pose nude online. Police have identified several victims and worry there could be more.

    Daniel Jones, 34, appeared before a Perrysburg Municipal Court judge by video arraignment Friday morning. He faces felonious charges after police said he solicited several underage girls on Facebook. According to police, Jones offered to pay the girls to perform nude online by web cam.

    Perrysburg Police arrested Jones just after noon Thursday in Levis Commons.

    Police also searched Jones' car, west Toledo home, and a north Toledo accounting office Jones runs.

    Neighbors said they were shocked.

    On his Facebook page, Jones posted pictures of his young daughter and the children's soccer team he coached. He wrote, "Just wondering where the woman is that I have been searching for."

    Police said they may have uncovered just the tip of the iceberg and fear there may be more victims. They said what Jones is accused of doing is a reminder for parents to closely monitor what kids are doing online. Find out if someone is talking to them and making them feel uncomfortable or asking them to do something that is inappropriate. If so, call the police.

    Jones remains in the Wood County Jail on a $75,000 bond.

    NFL Week 16: Miami Dolphins (5-9) at New England Patriots (11-3)

    The New England Patriots could potentially wrap up the No. 1 seed in the AFC with a win on Sunday and a little help ? and it sure doesn?t seem like Miami will pose much of a threat to the Pats.

    Losses by the Steelers and Ravens last week gave the Patriots a one-game edge in securing home-field advantage. The Patriots have won seven of their last nine games against the Dolphins. Even though they?ve lost their past two playoff home games, home is important for Tom Brady in the playoffs. In five road playoff games, Brady has six touchdown passes and six interceptions. In 10 home playoff games, Brady has 16 touchdown passes and nine interceptions.

    The loss of Andre Carter could be huge for the Pats, both for his impact as a pass rusher and against the run. Expect teams to challenge Mark Anderson there, and Reggie Bush is having a career year. Playing primarily at end in a newly installed 4-3 scheme, Carter provided the Patriots with a team-high 10 sacks. Without him, it?s possible the club could return to more of the 3-4 arrangement it has used in past years.

    Saturday?s game seems straightforward enough for the Patriots, who?ve outscored the Dolphins 117-45 in winning all three meetings over the last two seasons.     The Christmas Eve Torchlight Parade on Dollar Mountain is one of Sun Valley?s most venerable traditions, dating back further than the memory of any living resident.?More than merry exercise, the parade truly holds symbolic significance in the community?especially on this Anniversary year.?Seventy-five years ago this Christmas season, the Sun Valley Lodge opened its doors to the world and our celebrated resort was born. By now we all know the ?creation story? of how Averell Harriman and Count Felix Schaffgotsch, after combing the West, hand-picked Ketchum to be America?s premier ski resort, the next St. Moritz. With such a compelling narrative and host of characters ? the railroad, the Count, the celebrities from Hollywood?s golden age ? it is no wonder this town loves its heritage.

    ?

    Tomorrow night that history will come to life in the form of lights and fireworks. The parade itself speaks to Sun Valley?s Swiss and Austrian predecessors, who pioneered the mesmerizing trails of fire that snake down the mountain. The location, however, alludes to the resort?s own uniqueness, as Dollar was home to one of the first two chairlifts in the entire world (the other being on nearby Proctor Mountain). While the East was using rope tows and Europe was still relying on funiculars and tramways, Sun Valley began moving skiers like hanging bananas on the novel Dollar Mountain ?chairlift.? The idea was a momentous innovation that would shape the skiing world forever, and Sun Valley was at the heart of it.

    Yet the torchlight parade is a unique and festive Sun Valley time capsule, not only?for its connection to this area?s earliest beginnings, but because its participants have been doing it for years. Historically conducted by the Sun Valley Snowsports School, the parade is a nostalgic event, providing an opportunity for friends and family to remember those torch bearers who are no longer with us as they watch the snaking line of past instructors, sweeping right and left, and sharing in the tradition once again. According to ski school director, Allan Patzer, the torchlight has become a truly spiritual event and an honor for present instructors. Not simply a performance, it is an opportunity for remembrance, in more ways than one, of everyone and everything that has contributed to the foundation of this incredible community.

    Tomorrow night, after the Nutcracker On Ice Show, look towards Dollar. Rising nearly 630 vertical feet from the valley floor and bereft of trees, the mountain is the ideal host for the event, which will be followed, as always, by a show of fireworks. If you?ve never watched the parade before, this is your opportunity to take part in an elegantly poignant Sun Valley tradition.     EPA tells nation's dirty power plants to clean up (AP)

    WASHINGTON ? Clean up or shut down.

    That's the decision facing hundreds of the nation's oldest and dirtiest power plants under an Environmental Protection Agency rule announced Wednesday that will force plants to control mercury and other toxic pollutants for the first time.

    The long overdue national standards rein in the largest remaining source of uncontrolled toxic pollution in the U.S. ? the emissions from the nation's coal- and oil-fired power plants, which have been allowed to run for decades without addressing their full environmental and public health costs. About half of the 1,200 coal- and oil-fired units nationwide still lack modern pollution controls, despite the EPA in 1990 getting the authority from Congress to control toxic air pollution from power plant smokestacks. A decade later, in 2000, the agency concluded it was necessary to clamp down on the emissions to protect public health.

    At a press conference Wednesday at Children's National Medical Center in Washington, EPA Administrator Lisa Jackson said the regulation was the Obama administration's "biggest clean air action yet", trumping a landmark agreement to double fuel economy standards for vehicles and another rule that will reduce emissions from power plants that foul the air in states downwind.

    The administration was under court order to issue a new rule, after a court threw out an attempt by the Bush administration to exempt power plants from toxic air pollution controls.

    "Before this rule, there were no national standards limiting the amount of mercury, arsenic, chromium, nickel and acid gases that power plants across the country could release into the air that we breathe," said Jackson, listing the contaminants linked to cancer, IQ loss, heart disease and lung disease that are covered by the rule, and that also pollute lakes, streams and fish.

    In a video released Wednesday afternoon, President Barack Obama said the decades of delays caused by special interest groups that resulted in standards never being put into place for power plants "was wrong."

    "Today, my administration is saying, `Enough'," he said.

    When fully implemented in 2016, the standards will slash mercury pollution from burning coal by 90 percent, lung-damaging acid gases by 88 percent and soot-producing sulfur dioxide by 41 percent.

    Power plant operators will have to choose between installing pollution control equipment, switching to cleaner-burning natural gas, or shutting down the plant. None of those choices come cheap ? the EPA estimates the rule will cost $9.6 billion annually, making it one of the most expensive the agency has ever issued.

    Some power producers intensely lobbied the Obama administration to weaken the rule and to delay it, and Republicans in Congress passed legislation to do so, saying it would threaten jobs and the reliability of the power grid, and raise electricity prices.

    To ease those concerns, the administration will encourage states to make "broadly available" an additional fourth year to comply with the rule, as allowed by the law. Case-by-case extensions could also be granted to address local reliability issues, according to a presidential memorandum sent Wednesday to Jackson.

    In the memorandum, Obama directs the EPA to ensure that implementation of the rule "proceed in a cost-effective manner that ensures electric reliability."

    Environmentalists said Wednesday that the added flexibility did not jeopardize the public health benefits of the regulation.

    "After more than two decades of delay, dirty coal-fired power plants are going to be cleaned up in short order," said Frank O'Donnell, president of Clean Air Watch, who said the EPA "bent over backwards" to accommodate concerns about reliability.

    For those in the industry, and some in Congress, the concessions didn't go far enough.

    Oklahoma Sen. James Inhofe, the top Republican on the Senate's environment committee, said he would file a joint resolution, a rarely used Congressional tactic, to get the rule overturned.

    Some in the industry pushed for an automatic delay, or "safety valve," to make sure that plants that have to run to ensure reliability aren't found in violation of the rule and too many plants don't close down at once. In addition to those that will retire, hundreds of units will need to be idled temporarily to install pollution control equipment. Some of those units are at critical junctions on the grid and are essential to restarting the electrical network in case of a blackout, or making sure voltage doesn't drain completely from electrical lines, like a hose that's lost its water pressure.

    The Edison Electric Institute, whose members were split on the toll of the rule, said in a statement Wednesday that while the EPA "made useful technical changes", it believes "the administration is underestimating the complexity of implementing this rule in such a short period of time."

    The American Coalition for Clean Coal Electricity, which is an association of companies producing electricity from coal, said the rule will destroy jobs, raise the cost of energy and make electricity less reliable. A study by the group estimated that as much as 12 percent of coal-fired generation would be forced to retire due to the regulation.

    But an AP survey of 55 power plant producers found that estimate, and others, to be inflated. The mercury rule, along with another to reduce power plant pollution that blows downwind, will force portions of more than 32 mostly coal-fired power plants in a dozen states to retire, and put another 36 power plants on the brink of retirement. The impact is greatest in the Midwest and in the coal belt ? Kentucky, West Virginia and Virginia ? where dozens of units will likely be mothballed.

    But not a single operator interviewed said the EPA was solely to blame for the decision. And coal is still likely to be the country's dominant electricity source until 2035, according to the Energy Information Administration.

    For the older, aging plants, many of which only ran when electricity demand peaked, the rules were the final blow. Coal was already struggling to compete against low natural-gas prices, demand from China and elsewhere driving up its price, and lower electricity demand.

    The average age of the units retiring or at risk of shutting down was 51 years old, the AP found. And while they produce enough power for more than 22 million households, experts say they probably won't cause the lights to go out, because in many cases the power is being replaced.

    The Rise of the Singing Christmas Tree

    Like many of the showier elements of the modern megachurch, the Singing Christmas Tree had humble origins. The first Singing Christmas Tree likely took place in 1933 when a music professor at Belhaven College, a Christian liberal arts college in Jackson, Miss., teamed up with an engineer to craft a small wooden tree frame for the school?s all-female choir to stand in as it performed a series of Christmas carols. The concert took place outside so that members of the community could enjoy the event, and outdoor Singing Christmas Trees began to pop up on college campuses and in city parks in other cities throughout the South during the 1940s and ?50s.

    Bargainers reach deal to head off gov't shutdown (AP)

    WASHINGTON ? Congressional negotiators reached agreement Thursday on a compromise spending bill to avert a weekend federal shutdown. They also worked toward a deal renewing the payroll tax cut and unemployment benefits for another year but prepared a shorter version as a fallback.

    Senate Majority Leader Harry Reid, D-Nev., told reporters he was still optimistic that bipartisan talks on yearlong extensions of the Social Security payroll tax cut and unemployment coverage would succeed. But as a "Plan B," he said, they were working on a two-month extension as well, which would also prevent cuts in Medicare reimbursements for doctors during that period.

    "We're still working on the long-term" bill, Reid told reporters as he exited the Capitol after a day of talks over both the payroll tax and spending measures. As for the two-month version, he said, "We'll only do that if what we're working on doesn't work out."

    Reid's remarks put a slight damper on a day on which for the first time, Democratic and Republican leaders expressed optimism at prospects for swift compromise on their payroll tax standoff and a spending battle that had threatened to shutter federal agencies beginning at midnight Friday.

    A deal on a $1 trillion spending bill was reached after Republicans agreed to drop language that would have blocked President Barack Obama's liberalized rules on people who visit and send money to relatives in Cuba. But a GOP provision will stay in the bill thwarting an Obama administration rule on energy efficiency standards that critics argued would make it hard for people to purchase inexpensive incandescent light bulbs.

    The House is expected to approve the spending measure Friday, and the Senate could follow suit, possibly the same day.

    Donald Stewart, spokesman for Senate Minority Leader Mitch McConnell, R-Ky., said talks aimed at agreeing to a yearlong extension of the payroll tax measure will continue.

    "We're 12 hours into this debate, they just started talking," he said when asked about the two-month version of the bill. "I wouldn't hit the panic button."

    A senior White House official said the administration supported the two-month plan.

    Bargainers were considering the two-month extension of this year's payroll tax cut and unemployment benefits bill because so far, they haven't agreed how a yearlong extension would be paid for, said a Democratic aide who spoke on condition of anonymity to discuss the private talks.

    The two-month bill would cost $40 billion, according to the aide. It would be paid for from a list of around $120 billion in savings that bargainers are considering, including sales of the broadcast spectrum and raising fees that Fannie Mae and Freddie Mac charge to back mortgages, the aide said.

    The two-month extension would let lawmakers revisit the measure after returning to Washington after the holiday season. That could be risky because that work would come well into the 2012 presidential and congressional election year.

    Without congressional action, the payroll taxes would rise and extra benefits for the long-term unemployed would expire on Jan. 1. Doctors' Medicare payments would be automatically reduced that day by 27 percent, a reduction that could prompt some to stop seeing Medicare patients.

    "Right now, Congress needs to make sure that 160 million working Americans don't see their taxes go up on Jan. 1," said Obama, referring to the tax cut extension at the core of the jobs program he outlined in a nationally televised speech three months ago.

    House Speaker John Boehner of Ohio, the most powerful Republican in an era of divided government, agreed. "We can extend payroll tax relief for American workers, help create new jobs and keep the government running. And frankly, we can do it in a bipartisan way," he said.

    In the Capitol, the previous day's bristling rhetoric and partisan jabs all but vanished.

    Still another year-end bill, setting new rules for the handling of terror suspects in U.S. custody, won final congressional approval and headed to Obama's desk for his signature.

    Republicans agreed to consider changes to a $1 trillion spending bill compromise that they and at least one Democrat said had been wrapped up days ago.

    On the payroll tax cut bill, Democrats abandoned their demand for a surtax on million-dollar incomes that they wanted to include in the measure.

    At a news conference, Boehner minimized the concession, noting that Democrats lacked the votes to impose the surtax a year ago when they commanded 60 votes in the Senate. Even so, he said, "there was some movement yesterday from the White House and Democrat leaders" toward a compromise.

    Boehner also left open the possibility of a compromise on another key sticking point ? a House-passed provision that all but requires construction of the proposed Keystone XL oil pipeline from Canada to Texas Gulf Coast refineries.

    Construction "will put 20,000 people to work immediately And there are about 115,000 other jobs directly related to it," he said. Yet he skipped an opportunity to say construction of the project was non-negotiable as talks on the payroll tax cut bill proceeded.

    Obama has threatened to veto the House-passed bill, in part citing the requirement for the pipeline. The project has been studied for more than three years, but the president recently announced he would put off a decision until after the 2012 elections.

    At Obama's insistence, Congress cut the 6.2 percent Social Security payroll tax to 4.2 percent this year in an effort to stimulate the economy with more consumer spending. The president has proposed deepening the cut to 3.1 percent next year, but Republicans have only shown a willingness to renew it at this year's level.

    Obama also wants to leave in place a system that provides aid for up to 99 weeks for the long-term unemployed. The House-passed measure reduces the total by 20 weeks, a step that the administration says would cut off 3.3 million individuals and that Democrats are hoping to soften if not reverse.

    Reid indicated that a number of expiring tax breaks were on the table, as well, a list that included a provision that benefits commuters who use mass transit.

    The House-passed payroll tax cut measure relied on a pay freeze and increased pension contributions for federal workers, as well as higher Medicare premiums for seniors with incomes over $80,000, beginning in 2017. The bill would also raise a fee that is charged to banks whose mortgages are guaranteed by Fannie Mae and Freddie Mac and cancel more than $40 billion from the year-old health care bill, Obama's signature domestic achievement.

    The year-end, $1 trillion spending measure would lock in cuts that Republicans extracted from Democrats in negotiations conducted months ago against the deadline of a previous government shutdown threat. It funds 10 Cabinet departments, including the Pentagon and dozens of smaller agencies, awarding a slight increase to the military and veterans' programs while trimming most other domestic programs.

    The separate defense bill covered military personnel, weapons systems, the wars in Afghanistan and Iraq and more at a cost of $662 billion, $27 billion below Obama's request. The Senate approved it by a resounding 86-13.

    The main controversy revolved around a provision to require military custody for foreign terrorist suspects linked to al-Qaida or its affiliates and involved in plotting or attacking the United States. Under a change made to gain Obama's backing, the legislation would permit the FBI to arrest and interrogate foreign terror suspects, as is now the case.
